The Madras High Court on Friday said that a holiday declared by the government under the Negotiable Instruments Act will not be directly applicable for private entities covered under the Factories Act. The employees who did not turn up for work on such holidays will not be entitled to wages for that particular day, the High Court said.  Justice SM Subramaniam was hearing a plea filed by the management of Bimetal Bearings Limited of Hosur in Krishnagiri district of Tamil Nadu, which had challenged an order passed by a labour court, directing it to pay wages to 47 employees who did not work on July 30, 2015. While passing the order, the judge also quoted Dr APJ Abdul Kalam, saying, “Don't declare holiday on my death, instead work an extra day, if you love me”, as relevant to the case.  The case dates back to former president APJ Abdul Kalam’s demise on July 27, 2015 following which the state government had declared July 30, 2015, as a public holiday under the NI Act. Bimetal Bearings declared July 30 to be a paid holiday only for those who were on general and first shifts whereas those in second and third shift were directed to report to work. The union office bearers, however, requested that the second shift and third shift should also be granted holiday with wages as well.  Bimetal Bearings has one general shift and three continuous shifts. The general shift working hours is from 8.30 am to 5.00 pm. The first shift’s working hours are from 7.30 am to 4.00 pm. The second shift working hours are from 4.00 pm to 12.30 am, and the third shift working hours is from 12.30 am to 7.30 am.   The petitioner declined the union’s request but offered an alternate in which if the workmen of the second shift and third shift agreed to work on August 8, (their weekly holiday) it would exempt them from reporting from work on July 30. They further stated that the employees did not have the rights to have filed a claim petition under Section 33C(2) of the Industrial Disputes Act.  The section states, “where any workman is entitled to receive from the employer any money or any benefit which is capable of being computed in terms of money and if any question arises as to the amount of money due or as to the amount at which such benefit should be computed, then the question may, subject to any rules that may be made under this Act, be decided by such Labour Court as may be specified in this behalf by the appropriate Government.” The Court upheld that the state government’s holiday is not applicable to private entities covered under the Factories Act, set aside the November 2017 order by the Salem labour court directing the factory to pay them wages and stated that a ‘concession can never be construed as a legal right’. The concession, in this case, refers to the option offered by the factory to the second and third shift workmen of an alternate working day.

Chennai Metrowater hikes tanker price without any public announcement

Days after the northeast monsoon set in across Tamil Nadu, Chennai Metrowater has decided to hike the price of water loads plied to the city. However, no public announcement was made in this regard, taking many consumers by surprise when they received a greater bill amount than usual. A tanker with a capacity of 9,000 litres has gone from Rs 700 to Rs 735. However, officials stated that the 5% rise is a regular revision and dubbed it a ‘marginal’ one.  Speaking to TNM, a Chennai Metrowater official said that circulars to this effect have been issued to area engineers independently and no central direction has been given across the department. “This is a regular fortnightly price rise; it’s very marginal. They have not increased in between (the summer and now). It is linked to petrol prices.”  During the drought-like situation in the summer months, the parched city witnessed a strike by lorry drivers, further putting the residents in limbo. Residents of villages in and around Chennai had objected to lorry drivers drawing water from their wells for a cost.  “They (the water tankers) had raised a demand during the peak drought period that they could not operate at a fixed price. We had promised to arrive at a method for this. It was to be calculated factoring in the per trip transporting cost, according to fuel consumption and the fluctuation in fuel prices,” says the official, adding that this was not a permanent hike. “Any decrease in petrol price will also reflect,” said the official.  With the northeast monsoon setting in, the Cholavaram and Chembarambakkam reservoirs, which went bone-dry during the summer months, were replenished with the rains earlier this week. In addition to this, Andhra Pradesh released water from a brimming Krishna river on September 25 under the Telugu Ganga project, which reached Poondi reservoir by September 30. As on October 19, the water level at Poondi reservoir stood at 1194 mcft (million cubic feet) against its full capacity of 3231 mcft. The levels at Redhills, Cholavaram and Chembarambakkam reservoirs stood at 309 mcft, 78 mcft and 22 mcft respectively.

Following a complaint from Dinesh’s parents, the police has registered an FIR against those who put up the hoarding and Tamil Nadu Electricity Board officials as well.
Despite previous accidents and court orders, banners and hoardings in Tamil Nadu continue to be a menace, irrespective of their sizes. This time, a 13-year-old boy, who is the only son of his parents, died after being electrocuted by an advertisement-hoarding of a bank in Cuddalore district. According to the police, Dinesh Kumar, a class nine student, was on his way back home in Kullanchavadi from a Primary Health Centre at Ambalavananpettai, around three kilometres away. He was running a fever on Friday and hence had visited the Primary Health Centre. As he was riding his bicycle, he was trying to avoid a vehicle coming from the opposite direction. While trying to move out of the vehicle’s way, he allegedly lost his balance and came in contact with a pole on which the advertisement hoarding was mounted. “It was a small advertisement, around one to two feet in size. The wire which connected the bulb for that hoarding was disconnected and it was touching the pole. Dinesh Kumar touched the pole to balance himself as he was getting away from the vehicle. When he touched it, he was electrocuted since he was not wearing any slippers and the ground on which he was standing was wet due to rain. He fell unconscious and was rushed to the hospital,” a police officer told TNM. “However, he died on the way to the hospital. The hoarding that was kept on the side of the road was an advertisement of an ATM of Syndicate bank,” the police officer added. He also stated that it was not clear if the bank had the necessary permission to put up the advertisement at that spot. Following a complaint from Dinesh’s parents, the police have registered an FIR under Section 304A (Causing death by negligence) of the Indian Penal Code against the bank manager and the Tamil Nadu Electricity Board officials responsible for the disconnected wire on the pole. The police are investigating the case and have not yet arrested anyone.

One down, more to go: Tiruvallur police desilts village lake as monsoon hits state

The Tiruvallur district administration seems to be gearing up to make the best of the monsoon rains which began in the state a few days ago. The district police, with the support of the District Collector, have desilted a lake in Mappedu, making sure that the monsoon rains benefit the people living in and around the area. Gandhipettai is a village situated around 20 kilometres away from Tiruvallur. It falls under the jurisdiction of the Mappedu police station in Tiruvallur district. The village has a lake, known as the Thevarkadaiyanthangal, that is a little over 3.50 acres in area and had reportedly not been desilted for a long time. This is what prompted the police to take up the task of getting the lake ready to receive the monsoon showers. The initiating pooja for the task was conducted on the lakebed in the presence of the District Collector and the Superintendent of Police. Speaking to TNM about the task, a police officer who participated in the clean-up drive, said that the task was spread over nine days. “We began desilting on October 7 and ended it on October 16. The lake had silted up to three feet high,” he said. The district force had entrusted 50 policemen with the task of desilting the lake, with 10 policemen per team taking turns to clean it every day. The state government is also on a desilting drive in parts of Tamil Nadu. However, the police officer said that it might take months for the government’s attention to turn towards this lake. “The government is doing it. But this lake needed immediate attention because the rainy season is near. Hence we decided to do this ourselves,” he explained. An excavator and an earthmover were deployed to desilt the lake, too. “We also have plans to do a similar project in two or three other lakes in the district so that when rains come, the water will seep in to recharge the groundwater levels,” the officer said. The lake before clean-up After clean-up Tiruvallur was one of the districts in Tamil Nadu that were affected due to water scarcity during summer. It was also one of the districts in which the water-table fell at a faster rate than other districts in the state, as per a report.

First of 10 trains arrive for Chennai Metro's Phase 1 extension project

The first of the ten metro trains proposed for Chennai’s phase I extension reached the city on Saturday. This train will now be sent to the Chennai Metro Rail Limited’s depot in Koyambedu, where it be put through various tests in slow and high speed before it is used. These tests may take two weeks to a month. According to a report in the Times of India, the rest of the nine trains are expected to arrive by the end of February 2020. The Rs 3,770-crore, 9-km phase I extension project from Washermanpet to Wimco Nagar will be inaugurated next June. Ten trains are proposed to be used on this line. At present, the Chennai Metro has 42 trains from Alstom’s Sri City facility. The manufacturing of these 10 began in February 2019. According to The Hindu, a team of officials from Chennai carried out various tests over the last few months, including car body dimensional checks, watertightness check, static routine traction and brake tests before delivery. According to reports, the Chennai Metro has seen a spike in the number of users taking the metro over the last eight months. In August 2018, the daily patronage of Chennai metro crossed over 1 lakh for 19 days. In August of this year, over 26 lakh passengers used the metro, which is over 10 lakh more than the number of patrons in January 2019. Phase I of the Chennai Metro covers 45 km and consists of two corridors -- one from Washermanpet to Chennai Airport and another from Central to St Thomas Mount. CMRL is ready to set the ball rolling for its Phase 2 which will connect Madhavaram in north Chennai to Sholinganallur in south Chennai.

Heavy rainfall likely across Tamil Nadu for next 2 days: Regional Met Centre

The North-East monsoon this month is expected to bring heavy rainfall to Tamil Nadu.
The city of Chennai woke up to a rainy Sunday morning as predicted by the Regional Meteorological Centre, and according to Pradeep John, who goes by Tamil Nadu weatherman, the winds have changed from South-East to East, resulting in more rains. “Today morning when we wake up, we will see an active monsoonish day. Winds have changed from South-East to East and the clouds which were struggling to move from sea to land yesterday, there might be some improvement today and we might get some day rains today (sic),” he wrote. According to the Regional Meteorological Centre, Chennai recorded 100% humidity on Sunday morning and the temperature stood at 26.2°C. Heavy to very heavy rain is likely to occur at isolated places over the state for the next two days along with thunderstorm with lightning warnings for some places that may extend up to October 25, according to the RMC. As of October 19, Devala in Nilgiris district recorded the highest amount of rainfall in the state, measuring up to 13 cms. Sivalogam in Kanyakumari district recorded 12 cms, while Kumarapalayam in Namakkal, Sathyamangalam in Erode, Sankarankoil in Tirunelveli and  Mettupalayam in Coimbatore district recorded 6 cm each.  According to RMC, Chennai’s Meenambakkam recorded 0.2 mm rainfall on Saturday. Sathyabama University recorded 61 mm, Shollinganallur recorded 33 mm and Tambaram recorded 24 mm rainfall. The North-East monsoon this month is expected to bring heavy rainfall to Tamil Nadu. According to the Times of India, a trough, which is likely to intensify over the Bay of Bengal, is expected to bring very heavy rain to the city starting Tuesday. Tamil Nadu Weatherman also wrote that a ‘low’ or ‘trough of low’ on October 22 will see enhanced activity across the state.

9-year-old succumbs to dengue in TN, relatives allege negligence by hospital

Protests broke out on Saturday near the Ballammalpuram crematorium in Karur district, after the death of a 9-year-old girl due to dengue. Parents and relatives of deceased child Vaishnavi alleged that medical staff at the Karur Government Hospital had misled them in regard to the condition of the girl, leading to her death. The nine -year-old, according to her relatives returned on October 12 from school with a high fever. The very next morning, she was taken to the GH for a checkup, but doctors allegedly labelled it a regular viral fever and prescribed some medicines. However, her situation worsened by October 15 and she was taken to the hospital again."This time, the doctors ordered two tests," says her aunt Krishnaveni to TNM. "The result of the first test was negative for dengue and they told us to go back home. However, the second test said the child had dengue and we immediately rushed later that day to admit her in the hospital," she adds. Krishnaveni says that Vaishnavi seemed to be improving for two days but on October 17 she began to vomit violently."Vaishnavi had severe body pain as well. She vomited and then fainted. The doctors then took scans and other tests but told us that there was nothing to worry about. They told us to shift her to Trichy GH and claimed they didn't have adequate medication to treat dengue," says Krishnaveni. "They called an ambulance from our phone and made us shift there. But once we went to Trichy, the doctors said her lungs were filled with liquid and she was in a serious condition," she alleges. In Trichy, doctors inserted devices to help her breathe temporarily. But the young girl didn't survive. On Saturday morning, Vaishnavi died despite treatment. And that evening after taking her body back to Karur, the family protested the alleged negligence and misinformation from the Karur GH till police dispersed them."They lied to us and made us shift," alleges Krishnaveni. "First they failed to diagnose her correctly on Sunday and later they knew she was going to die and sent us to another hospital," she adds. The Karur GH has however denied the allegations. Dean Dr Rossy Vennila told the media, "It was her parents who decided to shift her to Trichy for special treatment at that stage. Before discharging, the patient should be kept in observation for 72 hours. Much complicated cases than this have seen complete recovery. Vaishnavi’s death is unfortunate and we express our deepest condolences to the bereaved family."

Tamil Nadu's home-grown brand 'Dindigul Thalapakatti Hotels' has raised a whopping Rs 260 crore from CX partners, a private equity firm. With this, the legendary biriyani outlet seeks to become the 'McDonalds of the Indian food industry' as it sets eyes on expansion in the country and abroad. The plan to scale up its presence nationally has been three years in the making and talks with investors began merely nine months ago. With 59 restaurants in India and 6 overseas (Malaysia, Singapore, Dubai, Sri Lanka, Paris in France and California in the US), the brand believed it was the right time to expand. With this investment, it seeks to penetrate deeper in Tamil Nadu and other locations in the south. While Kerala, Karnataka and Andhra Pradesh will be the first focus, metro cities in the north will be next."There is a huge amount of goodwill that the brand has, that should go beyond just Tamil Nadu. The promoter had to see what will help the company go to the next level. There is a huge growth possible for the brand and the promoter's vision is to see Thalappakatti become the McDonalds of South Indian cuisine," says a source close to the company. "And when I say McDonalds, I mean they institutionalised their processes so well that every McDonalds has the same taste. Similarly, we want to expand so that all South Indian diaspora can get the same biriyani, taste and quality everywhere," he adds. He points that the journey to present a product worth investing in has been three years long.  "We had to work on how to get there - in terms of gaining private equity, professionalising management and getting new technology in place. All this was a three-year process and then we were ready to go into the market," he explains. "Investors look for a certain amount of readiness. If you see home grown brands, they are mostly promoter driven and family run businesses. There are lot of difficulties for such businesses to get investments. So, we worked around this and made ourselves an investable company," he adds. The brand is confident that irrespective of the number of branches, the quality will not be compromised."We have a proprietary recipe, and masalas are still ground in Dindugal. The recipe is the heart and core of this restaurant. The rest of the work has become very institutionalised," he says.  "So, you don’t need a specialised chef to make. So, it will be easy to scale up. Irrespective of where you have it, it will taste the same. We are ready to grow further," he adds. However a challenge the brand is bound to face is the saturated biriyani market in states such as Andhra and Telangana. But they are not frazzled by this."Thalappakatti is a legendary brand and has its own distinct taste. There are over 10 types of biriyani in India. If people want the Dindigul type biriyani which uses seeraga samba rice, then Thalapakatti should be the go-to brand. Biriyanis will coexist much like India does," he says.  The advisor and ibanker to the transaction was M Vinod Kumar of Advay capital, Dindigul Thalapakatti has roots tracking back to 1957 and Sathish D Nagasamy is its Managing Director. It gained its name from its founder Nagasamy Naidu who wore a thalapa (turban) on his head. When he ran the restaurant, it was named Anandha Vilas Biriyani. But soon the biriyani outlet became synonymous with the turbaned man and adopted this brand identity in its name. Thalapakatti serves close to 4000 kg of biriyani from its outlets every day.

Zomato fined Rs 1 lakh after Chennai office found to be breeding ground for mosquitoes

Greater Chennai Corporation (GCC) on Friday fined food delivery giant Zomato after the company's office was found to be a breeding ground for mosquitoes. While 3,400 cases of dengue have already been reported from the state this year, the government is doing all it can to mitigate the spread of the fever. Speaking to TNM, P Madhusudhan Reddy, Deputy Commissioner (health), GCC said, “The unused delivery boxes were kept on the terrace of their premises. When our Vector Control Team visited, we found that there was water stagnant in all the bags which became potential breeding source for mosquitoes.” The premises located on Mcnicholas Road in Chetpet, Chennai. Zomato has been fined Rs 1 lakh for allowing mosquitoes to breed. “They have accepted their fault and duly acknowledged to pay the fine. They’ve also promised to make the premises clean,” he said. In less than 10 days, from October 10 to 18, Rs 20 lakh has been collected as fine by GCC from private, public and commercial establishments. A total of 387 offenders have been fined as a result. Integral Coach Factory too is among the list of those fined. “We are not leaving anyone. Private, public individual and commercial establishments are checked frequently. We tell them that it is a public health issue. If there’s one place of breeding, those in 300-metre radius are affected and those in 500-metre radius are possibly affected. Based on immunity level, some may or may not contract. But this will spread and we need to be very careful,” he explains. The GCC’s health department has close to 2200 staff deputed to go on such inspections daily. “If there are more than 2-3 cases reported from the same area, we will tighten our scrutiny,” DC adds. He further tells TNM that the aim of such inspections and fines are to raise awareness and to sensitise people to be more responsible in preventing such fevers from spreading.

Polling starts for TN's Vikravandi, Nanguneri Assembly bye-polls

The polling began amidst allegations of cash being distributed for votes in both constituencies.
Polling for the bypolls in Tamil Nadu's Vikravandi and Nanguneri assembly constituencies began on Monday morning to decide the electoral fate of 35 candidates in the fray. The polling will conclude at 6 p.m. The counting of votes would be taken up on October 24. Bypoll in Vikravandi was necessitated following the death of DMK legislator K Rathamani in June, while the Nanguneri seat fell vacant as Congress legislator H Vasantha Kumar resigned after he got elected to the Lok Sabha. A total of 23 candidates are in the fray in Vikravandi seeking the favour of about 2.24 lakh voters. The main fight is between ruling AIADMK's R Muthamilselvan and the principle opposition party DMK's N Pugazhenthi. On the other hand, Nanguneri seat will see 12 candidates fighting it out though the main rivals are AIADMK's V Narayanan and Congress candidate Ruby R Manohar. The total number of voters in Vikravandi is about 2.57 lakh. Authorities have asked people not belonging to the two constituencies but who were involved in electoral campaigning to leave and hotels/lodges/marriage halls have been asked to ensure outsiders do not overstay. Security has been beefed up in the two constituencies for peaceful conduct of polls. Leaders of AIADMK, DMK, Congress and other parties campaigned for their own candidates as well as for the candidate of their ally. For the ruling AIADMK, the campaign was spearheaded by Chief Minister K Palaniswami, Deputy Chief Minister O Panneerselvam, state ministers and others. On the other hand, for DMK, the campaign was led by party President MK Stalin and others. The leader of the Naam Tamilar Katchi Seeman created a controversy while campaigning for his party candidate in Vikravandi justifying theA gruesome killing of Rajiv Gandhi for sending the Indian Peace Keeping Force (IPKF) to Sri Lanka. During his campaign Seeman said history will be rewritten in the future to the effect that Rajiv Gandhi who had sent IPKF to Sri Lanka to kill Tamilians was later murdered in the Tamil land. A female Tamil Tiger suicide bomber blew herself up at an election rally near Chennai killing the former Prime Minister on 21.5.2991. Seeman was booked by Tamil Nadu police for his provocative speech with an intention to cause riot and intentional insult to breach the peace. A report on the cash seizure at Nanguneri assembly constituency from a house where DMK legislator KS Saravanakumar was staying has been sent to the Chief Electoral Officer, said a top official in Tirunelveli. Meanwhile at Nanguneri, some people from near by villages surrounded the house where DMK legislator representing the Periyakulam assembly seat and other DMK party members were staying and seized cash of about Rs.2.78 crore. "A first information report has been lodged and a report has been sent to the Election Commission," Shilpa Prabhakar Satish, Tirunelveli District Collector had told IANS. Saravanakumar alleged that the villagers had attacked him and stole his money, jewellery and his mobile phone. In the 234-member Tamil Nadu assembly, the ruling AIADMK has 123 members (including the Speaker), DMK-100, Congress-7, IUML and Independent-1 each and two vacant seats for which bypoll will be held on Monday. Puducherry bye-polls Voting in the bypoll for the Kamaraj Nagar assembly seat in Puducherry is also underway from 7 am on Monday and will end at 6 pm. There are nine candidates in the fray but the main contest is between Congress party's A John Kumar and AINRC nominee S Bhuvaneswarane. The bypoll became a necessity after Congress legislator V Vaithilingam was elected to the Lok Sabha in April this year. The counting of votes will happen on Oct 24.

TNSTC to pay Rs 31.5 lakh compensation to passenger injured in bus accident 4 yrs ago

The Tamil Nadu State Transport Corporation has been ordered to pay a compensation of Rs 31.5 lakh to a passenger who was injured in an accident that took place on the East Coast Road (ECR) four years ago.  According to the petitioner, S Guruprasad, the bus was heading towards Puducherry from Chennai when it rammed into a truck near Krishnankaranai. The petitioner also stated that the bus conductor and one other passenger died in the accident and many others were injured in the accident, which was caused due to rash driving by the bus driver, as per reports.  The TNSTC, however, responded to the petition by stating that the accident was caused due to the negligent act by the driver and hence the Transport Corporation cannot be held liable for the deaths and injuries or for offering monetary compensation. During the proceedings, the tribunal perused that the FIR that was registered after the accident and also recorded oral submissions from the passengers who were inside the bus and held that the driver’s rash driving caused the accident. The Tribunal also observed that the petitioner himself was severely injured in the accident and underwent treatment for over a year and also had to endure four surgeries.  The Tribunal also read through the petitioner’s medical records and considered his elbow injury as 50% partial permanent disability. It also considered that he worked as a sales executive when the accident occured and based on his earnings lost and other factors, the Tribunal held that Guruprasad was eligible for compensation. Based on Guruprasad’s age at the time of accident, the Tribunal ordered that TNSTC was liable to pay Rs 31.5 lakh as relief to the petitioner for his suffering due to the accident.

Schools to be shut in three Tamil Nadu districts as heavy rains predicted

As rains continue to lash parts of Tamil Nadu over the weekend, schools and colleges in a few districts will remain shut on Monday as per an order from the district collectors.  Northeast monsoon arrived in Tamil Nadu a few days ago, bringing heavy showers with it across the state. The rains have been widespread so far, disrupting the normal lives of the people living in the state. The incessant rains have forced the district collectors of Coimbatore and Kanyakumari to declare holidays for all the schools and colleges on Monday. In Sivaganga district, the district collector has declared holiday only for schools due to the rain. In Chennai, the district collector has stated that the schools and colleges will function normally on Monday.  Kanyakumari, Ramanathapuram, Thoothukudi and a few places in Chennai district recorded massive rainfall on Sunday, as per data posted by independent weather blogger Pradeep John. Kuzhithurai in Kanyakumari district recorded the highest amount of rainfall, recording 140 mm in a span of 24 hours. Suralode and Mylaudy in Kanyakumari district recorded 83mm and 67mm of rainfall, respectively, on Sunday.  According to the Indian Meteorological Department forecast published on Saturday, heavy to very heavy rainfall is likely to occur over isolated places in Tamil Nadu on Monday and Tuesday. About a week later, he tweeted the Tamil translation of the poem. To mark 150 years of Mahatma Gandhi, Narendra Modi had invited several Bollywood stars on Saturday, and released a video as a tribute to Gandhi. The event was attended by Shah Rukh Khan, Aamir Khan, Sonam Kapoor, Jacqueline Fernandez, Kangana Ranaut, Imtiaz Ali, Ekta Kapoor and several other Bollywood celebrities. The tribute video directed by Rajkumar Hirani, who has been accused of sexual assault, featured Bollywood actors Aamir Khan, Salman Khan, Ranbir Kapoor, Alia Bhatt, Sonam Kapoor, Kangna Ranaut and Vicky Kaushal. However, both Khushbu and Upasana took strong exception to the alleged absence of southern actors in the event. Congress leader and Kanyakumari MP H Vasanthakumar was detained in the Nanguneri police station on Monday, even as bye-polls continued in the Assembly constituency. Bye-elections in two Tamil Nadu assembly constituencies -- Vikravandi (Villupuram district) and Nanguneri (Tirunelveli) -- were underway on Monday. While bye-polls became necessary in Vikravandi after its legislator, K Rathamani, from the DMK, passed away in June, Nanguneri’s MLA seat fell vacant after its incumbent H Vasanthakumar was elected as the MP for Kanyakumari district. On Monday, Vasanthakumar, the former Nanguneri MLA, was allegedly on his way to Nagercoil from Palayamkottai. Speaking to TNM, a police officer at Nanguneri station said that Vasanthakumar is being questioned on a possible violation of the Model Code of Conduct that is in place due to the bye-elections. However, speaking to TNM from the Nanguneri police station, Vasanthakumar said, “There is no explanation for why I have been brought to the police station.” Stating that he was an elected representative of the people he said, “If they are treating an MP like this, it means they are insulting the Parliament itself.” Justifying his visit to Nanguneri on polling day, Vasanthakumar said that there was no rule which stated that travelling on the road to Nanguneri was wrong. “Election is happening and there is a Code of Conduct in place. If I had campaigned within the booth, then this (detaining me) makes sense. But there is no rule that says I shouldn’t travel on the road. I travelled even without the party flag,” he added. A total of 23 candidates are contesting in Vikravandi, which has around 2.24 lakh voters on the roll. The main contest is between R Muthamilselvan from the AIADMK and N Pugazhenthi of the DMK. There are 12 candidates fighting for the mandate in Nanguneri, which has around 2.57 lakh voters on the roll. V Narayanan of the AIADMK and Ruby R Manohar are the prime candidates seeking the voters’ favour in Nanguneri.

Chennai cops refuse permission to citizen group to protest against civic issues

Chennai based citizen group Chitlapakam Rising has been at the forefront of resolving civic issues plaguing their neighbourhood. However, on Tuesday, the city police refused permission to the NGO to stage a peaceful protest urging the government to expedite de-silting of the Chitlapakam lake and remove the mounting garbage in the locality. According to members of Chitlapakam Rising, the Chennai Police Commissioner rejected their request citing law and order concerns. The group had planned to stage the demonstration on October 20 with the main focus on the delay in lake de-silting by the government. Earlier in 2019, members of 'Chitlapakam Rising had grabbed headlines when they embarked on a lake clean up mission. However, they stopped after Chief Minister Edappadi Palaniswamy announced Rs 25 crore in July for the renovation of the Chitlapakam lake under Section 110 of the Tamil Nadu Assembly Rules."A bit of the work was started in July and the the private agency who got the contract managed to clean up 10-15 percent of the southern portion of the lake which is dried up. However, the contractors abandoned the work and left in a month later, complaining that the government fund of Rs 25 crore was not released," says Salesh, a member of the group. With the North-East monsoons already hitting the state, de-silting work will be even more challenging, Salesh adds."If the work is not completed by this year, we will again suffer water shortage next year. In 2018, we really struggled with water scarcity as the lake did not have water and the water from the Chitlapakam-Madambakkam pipeline project fell short of the residents water requirement," Lakshmi, a core member of Chitlapakam Rising told TNM. Mounting garbage  The group has also raised the issue of garbage being dumped in the locality and the corporation officials refusing to remove it. Currently, garbage has been dumped in a huge pile behind the Panchayat office in Chitlapakam 2nd main road.  The group also claims that the Panchayat authorities stated that there was no other place to dump the gargage and hence it could not be cleared. "There are several related issues which are pending resolution. The single use pastic ban has not been executed in this locality well. Electricity postmaintenance, garbage segregation etc are not attended to. We do not even have a permanent Executive Officer who is responsible for these issues," Lakshmi added.  Residents allege shoddy work done in the name of drain project  The incident comes a year after the NGO had been denied permission to stage a protest against the arrest of two of their members. Then too, the police had cited law and order concerns for denying permit. The two members were arrested on false charges for questioning the government on the shoddy work done in the name of 'cut and cover'  project to drain out flood water being executed in the area. "The PWD had started the cut and cover project last year. When we had asked for details of the project, they promised to give us the work order copy. But they did not deliver this promise. Further,  the project itself had been delayed by 6 months from the date of tender confirmation," Lakshmi says.  Residents have also highlighted the poor manner of execution of the cut and cover project undertaken by the Public Works Department (PWD). "Cut and cover drain project initiated by the Public Works Department is making no progress, especially at Balaji avenue. From this street, the drain channel should lead to the Sembakkam lake for the flood water to flow into the lake. However, an effluent treatment plant belonging to the Chitlakapakam Town Panchayat is obstructing construction," Dayanad Krishnan, a resident of Chitlapakam wrote to a daily newspaper.  However, the group managed to receive permission to protest from the Madras High Court. This time too, the group plans to appeal to the court in order to seek permission to protest the government's civic apathy. "Now that the police have refused to give us permission, we will approach the court in order to get permission. Our members are already preparing to move the High Court," Salesh said.  In September, Chitlapakam was in the news after a 42-year-old resident died after an electric pole collapsed and fell on him, while he was feeding stray dogs. Following the accident, members of Chitlapakam Rising highlighted the condition of electric poles in the neighbourhood by conducting a survey. The success of 'Asuran' and what it means for cinema with Dalit protagonists

In the midst of a festival season like Durga Puja and Dasara, where the killing of an Asura (meaning demon or devil) is celebrated, a movie named 'Asuran' has become a big box-office hit.
Asuran, a Tamil film starring Dhanush, released on October 4 and has become his biggest hit. It has also become the highest grossing Indian film at the Malaysian box-office this year, beating Bollywood’s multi-starrer War. Asuran is the life story of Sivasamy (Dhanush), a Dalit man who avenges the death of his family members who are victims of caste-based violence. Based on Sahitya Akademi award winner Poomani’s novel Vekkai, the movie deals with panchami land rights — the land given by the British to Scheduled Castes, which cannot be transferred to others. Clearly, Sivasamy is the protagonist of Asuran. The story is based on his struggle and is narrated from his point of view. In a conventional narration, Sivasamy would be an aggressive young liquor baron who impulsively ‘defies’ social order. But, director Vetrimaaran takes you through the journey of Sivasamy’s life both as a young man and a father and makes an appealing emotional connect with the audience. Asuran’s story, of the land rights of the Dalits and the atrocities inflicted on them in Tamil Nadu villages, appears real and can be related to the anti-Dalit atrocities across the country. Vetrimaaran dexterously uses the art of compelling storytelling, as the audience stands behind the protagonist Sivasamy and feels his agony and ecstasy. Adapting Vekkai In doing so, the director has also modified some portions of the novel to illustrate his point. Poomani had dismissed the notion that his novel portrays the victory of Dalits over their oppressors. Calling it as the director’s freedom to alter the script from a story about a family defending its honour to the idea of a Dalit revolt against the oppression, the director commended Vetrimaran for handling the violence well. In one of the moving scenes, Sivasamy’s fiancée Mariyammal (Ammu Abirami) is humiliated for wearing slippers to her school — a scene not part of the original novel (per the novelist) —but the director has taken it from real life examples of caste-discrimination. In June 2013, a Dalit schoolboy in Vadugapatti in Usilampatti taluk was paraded and forced to carry his footwear on his head. The incident happened when he went to check his exam results wearing footwear, and ‘offended’ the upper caste for ‘breaking the tradition of Dalits remaining barefoot’. In May 2011, when a Dalit youth G Thangapandian bought a bike, a luxury considered exclusive to the upper castes in Villur village in Marurai, his house was attacked. The 1200 household village had unwritten rules that forbade Dalits from wearing footwear while passing through upper caste localities. Tamil Nadu, the land of anti-caste revolutionary Periyar, has ironically been mired in controversies relating to caste-based atrocities. As recent as August this year, a highly objectionable school circular on caste bands for students was circulated and met with much protest. Caste-based stories on social injustice told from the point of view of Dalit protagonists have recently been gaining prominence in Tamil cinema, with Pa Ranjith successfully showcasing such narratives in Madras, Kaala, Kabali and Maari Selvaraj’s Pariyerum Perumal. Vetrimaaran’s Asuran is a marvelous addition to this new tradition. The alternative perspective Marathi filmmaker Nagraj Manjule, during the first Dalit Film Festival in New York, had said, “Movies are made out of perspectives. If a movie is made keeping Ram in mind, then Ravana automatically becomes a villain. But if someone makes a movie based on Ravana’s viewpoint then, Ravana may be a hero and Ram a villain.” I believe this is precisely what Asuran does. It makes us connect with Sivasamy and makes him a hero. If the story did not come from Sivasamy’s viewpoint, traditional societal bias would have made the audience dismiss his family as criminals and murderers. The movie’s title Asuran (meaning demons) isn’t a random pick but a carefully chosen, essential component of the story. It epitomizes how the people who are dismissed as demons have a humane side too. For long, in Indian traditions, the Asuras have been characterised as wicked and evil. In his book Revolution and Counter Revolution in Ancient India Dr. Ambedkar writes: “It is believed that the Asuras were not a human species at all. They are held to have been ghosts and goblins who plagued the Aryans with their nocturnal visitations. The description of Asura given, in the Mahabharat and Ramayana make out as though they belonged to nonhuman world. An Asura is described to eat ten carts-load of food. They are monsters in size. They sleep for six months. They have ten mouths. Who is a Rakshas? He too is described as a non-human creature.” Calling these beliefs as “unfounded”, Dr Ambedkar adds: “The word Asura is generic name given to various tribes known by their tribal names of Daityas, Danavas, Dasyus, Kalananjas, Kaleyyas, Kalins, Nagas, Nivata-Kavachas, Paulomas, Pishachas and Rakshasas…  Fortunately with the help of the Buddhist literature, Ancient Indian History can be dug out of the debris which the Brahmin writers have heaped upon in a fit of madness. The Buddhist literature shows that the Devas were the community of Human beings…and the Asuras again are not monsters. They too are Jan-Vishes Human beings.” Asuran, to me, is simply a demonstration of Babasaheb’s assertion that Asuras were human who were wrongly dehumanized for long.  Sivasamy’s Asuran is human – one who has compassion, fear and anger —just like other humans. Another striking aspect about Asuran is the timing is its release.  In the midst of a festival season like Durga Puja and Dasara, where the killing of an Asura (meaning demon or devil) is celebrated, a movie named Asuran has been released and has become a big box-office hit. This shows that orthodox notions can be convincingly overcome if the challenge is taken up. One of the main reasons for our filmmakers to stick to traditional ways of storytelling is the apprehension regarding the box-office success of ‘alternative’ cinema. Asuran’s success affirms that telling a story from the Dalit point of view can be mainstreamed and become profitable as well. Views expressed are the author’s own. Red warning in parts of Tamil Nadu, heavy rains may lash Chennai

A red warning for extremely heavy rainfall has been issued to parts of Tamil Nadu even as the northeast monsoon descended over the state last week. On Monday, the Regional Meteorological Centre in Chennai issued a red warning for Tuesday. “Extremely heavy rain (more than 20 cms) is likely to occur at isolated places over Tamil Nadu (the hilly areas of Nilgiris, Coimbatore, Theni and Dindigul districts).” it said. Heavy to very heavy rain is also likely to occur at isolated places over Dharmapuri, Krishnagiri, Salem, Vellore and Thiruvannamalai districts of Tamil Nadu. Speaking to media persons in Chennai on Friday, S Balachandran, Director, Area Cyclone Warning Centre, Chennai, said, “As far as the next two days are concerned in Tamil Nadu and Puducherry, most areas will receive rainfall. Southern districts like Kanyakumari, Tirunelveli, Thoothukudi, Ramanathapuram, northern districts like Tiruvallur, Nilgiris and Coimbatore will experience extremely heavy rainfall in some parts. Delta districts, Cuddalore, Villupuram, Tiruvannamalai, Vellore, Salem, Madurai, Theni, Dindigul, Erode and Tiruppur will experience heavy rainfall in some areas.” Fishermen have been advised not to venture into south-west Bay of Bengal or the sea by Kanyakumari on Monday and Tuesday. “The sky condition is likely to be generally cloudy. Light to moderate rain/thunder showers likely to continue, heavy at times. Maximum and Minimum temperatures are likely to be around 29 and 24 deg Celsius respectively,” the IMD bulletin stated.  Thunderstorm with lightning is likely to occur at isolated places over the state between Monday and Wednesday. According to the Commissionarate of Revenue Administration and Disaster Management, Kanyakumari district recorded the highest rainfall at 768 mm as on Monday, followed by Coimbatore (601.40 mm) and Nilgiris (665.60 mm). City-based weather blogger Pradeep John, who runs the popular Facebook page Tamil Nadu Weatherman has also predicted heavy rains for coastal areas including Chennai on Monday and Tuesday.

TN Transport dept to operate almost 11,000 buses for Diwali from Chennai

These buses will be operated from Thursday to Saturday to clear the extra rush of passengers moving to their hometowns to celebrate the festival.

With Diwali around the corner, the Tamil Nadu’s state transport department is gearing up to facilitate commuters to reach their hometowns on time for the festival. The department has decided to operate 10,940 buses from Chennai to various parts of the state to clear the Diwali rush.  As per reports, the buses will be operated on Thursday, Friday and Saturday from different bus-stands within and on the outskirts of the city — Chennai Mofussil Bus Terminus (CMBT), Madhavaram new bus-stand, Arignar Anna bus-stand in Tambaram-Sanatorium, KK Nagar MTC stand, Tambaram railway station bus-stand and Poonamallee bus-stand. The department will also operate special reservation counters during these days in these bus-stands to enable passengers to travel to their homes.  The department has also initiated changes in the routes in which buses will be operated on these days. Buses travelling to Andhra Pradesh — TNSTC and the APSRTC services — via Red Hills will be operated from the Madhavaram new bus-stand. Buses that operate via the East Coast Road (ECR) to Puducherry, Cuddalore and Chidambaram will start their journey from the KK Nagar MTC stand. Buses to Kumbakonam, Thanjavur via Tindivanam will be operated from the Arignar Anna bus-stand at Tambaram-Sanatorium.  Buses bound to Kancheepuram, Arcot, Arani, Vellore, Dharmapuri, Krishnagiri, Tirupattur, Hosur, Chittoor and Tirupati via Tiruttani will leave from Poonamallee bus-stand. Tambaram railway station bus-stand will operate buses to Tiruvannamalai via Tindivanam, Panruti, Neyveli, Chidambaram, buses scheduled to Puducherry, Chidambaram and Cuddalore via Tindivanam etc.  The department also stated that buses from CMBT scheduled to other parts of the state via the GST road will ply through Maduravoyal, Poonamallee, Nazarathpet, Outer Ring Road and Vandalur to reach the temporary bus-stand in Urapakkam, instead of plying through Tambaram-Perungalathur stretch. On account of Diwali, the state government has also announced a local holiday on October 28, 2019, Monday for all the government offices and educational institutions in the state. To compensate for the holiday, November 11, 2019 (second Saturday) will be a working day, as per the Government Order issued on Monday.

Holding up rigorous imprisonment as punishment for a child rapist, the Madras High Court on Monday made clear observations on rape, stating that courts have to believe what the child-survivor says in such cases, and not to brush aside the survivor’s version based on a technicality.  Justice S Vaidyanathan said that the misconception that the children are made to lie by their parents must not affect the manner in which courts respond to cases of child sexual abuse.  According to reports, the high court was hearing a case in which a man had sexually assaulted a five-year-old girl in Nagapattinam in 2011. According to the case, the man Ganapathy, had raped the girl when she was playing with her friends. Based on a complaint given by the girl’s mother, the Nagapattinam police had registered an FIR against Ganapathy for rape.  Justice S Vaidyanathan, who was hearing the case on Monday, junked several arguments made by the defence on technical lines, as per reports. He also overruled several arguments made by the counsel for the accused in relation to the trustworthiness of the victim’s statement, absence of injuries on the child, and initial delay in filing the complaint.  On arguments that accused the mother of delaying the filing of a complaint, Justice Vaidyanathan said that the rape of a girl of a tender age will have adverse effects, which her family needs time to recover from before they rush to the police station to lodge a complaint. Attributing the delay to normal human conduct, the judge also said that in a village setting, neither the girl nor her parents would be tempted to rush to the police station immediately.  With regards to arguments that pointed to the absence of external injuries, the judge said that it is not possible to find bloodstains on the girl’s body four days after the rape. He also pointed out that there is no reason to not believe the victim’s statement especially when she has withstood cross-examination even after two years of the incident.
