Madurai botched abortion: Two member fact-finding mission to investigate

Less than a week after the discovery of a botched abortion in Madurai which led to the death of a 28-year-old woman, a probe panel has been constituted by the Directorate of Medical and Rural Health Services to investigate the death. According to a report in the Times of India, a two-member fact-finding mission will investigate the incident that took place in Usilampatti in Madurai district. According to the police, Ramuthayi, who was in the seventh month of her pregnancy, went to a private hospital on Saturday, requesting an abortion. However, since the termination of pregnancies over 20 weeks is illegal, she was turned away by the doctor. On her way out of the hospital, she met Jayalakshmi —  a nurse she had befriended, — who offered to perform the operation. Jayalakshmi administered an injection to abort the pregnancy on Saturday evening, Ramuthayi was pronounced dead the next day. Jayalakshmi has been arrested. After news broke about the incident, there was suspicion that Ramuthayi and her husband Ramar, who already have three children, opted for sex-selective abortion. According to TOI, which quotes N Rukmini, Director of Medical and Rural Health Services, the foetus was male. “The medical officers say ultrasound scans were done to check the health of the foetus. But the report does not mention the sex of the baby, as per the law. We don't know who misled the woman. Senior officers from the health department and the police will investigate the matter and submit a report,” she said. While prenatal sex determination has been prohibited in India since 1994 and is a punishable offence, there are still pockets where female infanticide continues to take place in the state. According to the newspaper, Jayalakshmi has been booked under Indian Penal Code Section 314 (Death caused by act done with intent to cause miscarriage), Section 6(2) of the Medical Termination of Pregnancy Act, 1971, and Section 15(3) of the Indian Medical Council Act, 1956.

TN Electricity Minister refutes Rs 1000 crore coal purchase scam allegation

An NGO said that TANGEDCO allegedly paid Rs 1,000 crore more to the contractor who was responsible for handling coal from the Vizag Port.
A day after an anti-corruption NGO released reports alleging a Rs 1000 crore scam in the purchase of coal in Tamil Nadu, state Electricity Minister P Thangamani refuted the same, stating that there were no irregularities. According to Arappor Iyakkam, the anti-corruption NGO, Tamil Nadu Generation and Distribution Corporation (TANGEDCO) allegedly paid Rs 1,000 crore more to South India Corporation Limited, the contractor responsible for the movement and handling of coal from the Vishakapatnam Port between 2011 and 2016. The NGO alleged that invoicing of the services provided by the port led to the discovery of irregularities to the tune of Rs 1000 crore. DMK President and Leader of the Opposition MK Stalin had also slammed the Minister over the irregularities. According to Deccan Chronicle, at a press conference in Chennai on Thursday, the Minister said that three government officials had been suspended for allegedly colluding with a private power generation company and causing a loss of Rs 11 crore to TANGEDCO. “There was no 'scam,' as Stalin claims. It was a demand notice served to a private player for utilising state's infrastructure, called wheeling charges. It was found out in the state electricity department's internal audit and appropriate action has been taken against three officials,” Thangamani said. "I wish to clarify that it was not a case of the department shelling out money when there was no procurement, instead, it was a demand notice from the department about power purchase between two projects for which monies are owed to the department," he added. According to the Times of India, when Minister P Thangamani was asked about a Vishakapatnam-based coal contractor whom the government had employed for a long period of time, he cited a stay order granted by the Madras High Court which reportedly prevents the government from identifying new contractors. According to TOI, TANGEDCO Chairman and Managing Director Vikram Kapur himself admitted that the 13-year-old stay order was 'ridiculous' and that they were attempting to vacate the stay and float a tender to identify new contractors.

‘Return temple elephant Masini to original habitat’, seeks petition to Madras HC

Months after Masini, the 11-year-old female elephant made headlines for trampling her mahout to death at the Samayapuram Mariamman Temple in Trichy district, Tamil Nadu, a petition now seeks her return to the wild. In a petition moved by Chennai-based animal activist Antony Clement Rubin, he appealed to the Department of Environment and Forests to take steps to permanently shift Masini to her original habitat in Theppakadu Mudumalai Camp in the Nilgiris. In May, the pachyderm knocked her 48-year-old mahout, Gajendran, off her back, inside the temple. As Gajendran tried to bring Masini under control, she trampled him to death. Isolated from her herd In his petition, Antony claims that in 2016, after then Chief Minister J Jayalalithaa gifted Masini to the Samayapuram temple, Masini started developing behavioural changes. In his petition, Antony states that Masini had developed a strong bond with other elephants at the Theppakadu Camp, where she was raised for nine years. This bond, he says, was broken once she was isolated from her herd and shifted to the temple. As the petition states, “When she was living in the camp, she was surrounded by a herd of wild animals and was nurtured with absolute freedom of movement in a natural and free environment with plenty of care and support. After having shifted to the temple, she exhibited great difficulty in getting accustomed to chained captivity, without any free movement.” Following the tragic incident at the temple, Masini is undergoing treatment at the Veterinary College and Research Institute at Orathanadu, Thanjavur. Inaction of authorities The petition slams the Chief Conservator of Forests, Tamil Nadu for not having acted earlier despite several letters written, over the years, to shift Masini back to the camp. Speaking to TNM, SV Pravin Rathinam, counsel for the petitioner alleges that that temple authorities are in gross violation of government-issued rules and regulations on the maintenance of temple elephants. He says, “Firstly, we have sought for Masini’s rehabilitation. We hope Masini’s case will serve as a precedent for the right treatment of other elephants. We are asking for a legal right for the elephants to not be ill-treated.” Behavioural changes Antony seeks that Masini and other elephants be granted the status of legal persons. He explains, “Elephants have a complex social organisation, which is heavily dependent on culture. They also compete with each other, teach each other, share knowledge, understand vocalisations, show empathy and do course planning and risk assessment. It is also pertinent to state that elephants also recognise themselves in the mirror and mourn when their loved ones die. All these behavioural characteristics point to an understanding of ‘self’, life, death and bereavement. An understanding of such complex concepts demands elephants be classified as ‘moral and legal persons’.”

55,000 tons of imported sand put up for online booking by TN govt

The river sand had been imported from Malaysia and had been kept at the Thoothukudi port following a legal wrangle between the state and the company.
The Tamil Nadu government, on Friday, opened bookings for the online sale of the stock of imported sand kept at the Thoothukudi port. In its website, the TN government has displayed a notice, listing the prices per unit of sand that was imported from Malaysia. One unit of sand is priced at Rs 9,990 while five units are priced at Rs 49,950. The website also mentions that sand will be sold to anybody who books it online, irrespective of which state the buyer belongs to. The bookings can be made through the website and also through the TN Sand Mobile app. This marks the end of a dispute between the Tamil Nadu government and a private company from Pudukkottai, which is the importer of the sand from Malaysia. Background A Pudukkottai-based private company had struck a deal with a Singapore-based company to import river sand quarried in Malaysia. The first consignment of around 55,000 tonnes of sand landed at the VOC Port in Thoothukudi in October 2017. The issue began when the lorries hired by the company to transport the imported sand to the customers were seized by the Aralvaimozhi police. The reason for seizure was a Government Order issued by the state that said imported sand cannot be sold within Tamil Nadu. The seized sand was sent to the Assistant Director of Geology and Mines; meanwhile, the District Collector of Thoothukudi ordered the port to not release the remaining stock of sand from the port. The Madras High Court had earlier banned the quarrying of sand in the state and restricted the state from opening any new sand quarries. The TN government filed an appeal against this order in the Supreme Court, saying that this move by the High Court would be disastrous to construction activities in the state, since sand was a basic raw material. It also submitted to the apex court that it would regulate the sand trade in the state. Meanwhile, the company filed a petition at the Supreme Court saying that it was aggrieved by Tamil Nadu’s policy to not sell imported sand in the state. It also submitted that the company had adhered to all the requirements according to the Central government’s policy on importing sand. The TN government also submitted that the High Court’s move will encourage the import of sand, which will be expensive for those in need and sought that the High Court’s order be quashed. It also stated that while it cannot allow the imported sand to be sold in the state, it has no problem with the importer selling the sand to other states. In July, however, the state government stated in the apex court that it was willing to buy the sand that was lying in the Thoothukudi port for use within the state and that a committee would meet the representative of the importer company to arrive at a mutually agreeable price. The importer and the government are yet to decide on a negotiated price for the sand and the court on Thursday has given a week’s time for both the parties to come to an agreement regarding the transaction value for the deal.

The tracklist of Vetrimaran’s Vada Chennai, starring Dhanush in the lead, has been released. The jukebox has eight songs, composed by music director Santhosh Narayanan. Known for his inclusion of diverse singers and genres, the first song in the album is 'Sandhanantha', sung by Ka Ka Balachander and Gana Bala. Dhanush has crooned 'Goindhammavaala', penned by Rakesh. Promising to be a mellifluous medley, 'Kaarkuzhal Kadavaiye' is sung by a host of big names in the industry, including Sriram Parthasarathy, Vijaynarain, Ananthu, Santhosh Narayanan and Pradeep Kumar. The lyrics for this song have been penned by Vivek. Dhee, who enthralled audiences with her 'Kannamma' song in Kaala, is back with 'Maadila Nikkura Maankutty' along with Gaana Bala. In what looks like an aural surprise for the audiences, Gaana Bala himself has penned the lyrics for this song. The next song in the tracklist is 'Ennadi Maayavi Nee', both written and sung by Sindhai Rev Ravi. 'Mathiya Serayila', probably a song from the prison we see in the trailer, is also penned and sung by Arivu. And finally, 'Alangara Pandhal' is performed by Dhalak Jegan. The film details the challenges he faces during the course of his journey. Touted to be director Vetrimaaran’s most ambitious film, the trailer was released on July 28. HC issues notices to TN govt, EC over PIL seeking removal of political party flag masts

Hearing a PIL seeking the removal of flag posts put across the city, Madras HC has asked TN govt and EC to submit their responses within 4 weeks.
The city of Chennai can soon hope to rid itself of the political party flags put up at every corner, as the Madras High Court has sent notices to the Tamil Nadu government and the Election Commission. The court was hearing a PIL by A Radhakrishnan of Salem seeking the removal of the flag posts, according to a report in the Times of India. A division bench of Justice N Kirubakaran and Justice MV Muralidharan have asked the government and EC to submit their responses within 4 weeks.  In the PIL, the petitioner has accused political parties of encroaching roads, children’s parks and other public places to erect their flags. In some cases, the petition alleged, these activities hinder vehicular movements, creating a nuisance for the people. The petition also said that the state EC guidelines clearly mandate parties to remove the structures if they have already been erected. It also asked for a complete ban on erecting temporary as well as permanent flag posts on streets and other such public areas. The election commission had directed revenue officials and the government to remove all flag posts and hoardings erected by political parties, however, no follow up action had taken place on this directive, the petition observed.  The petition also stated that such acts are punishable under Section 3 of Tamil Nadu Public Property (Prevention of damage and loss act), 1992. Apart from party flags, Tamil Nadu has struggled with the menace of illegal banners and hoardings for a long time now, without much success. In November 2017, the Madras High Court ordered for all illegal hoardings to be removed after a 32-year-old reportedly crashed into an illegal hoarding, ahead of MGR's centenary celebrations, and died. In February this year, a motorist who was travelling to Conoor sustained a head injury after an illegal banner dedicated to CM Edappadi K Palaniswami fell on him. Illegal hoardings for superstar Rajinikanth also cropped up along a 6-km stretch on a Maduravoyal main road in March. The hoardings had incited huge protests by activists. Ramaswamy had even visited Maduravoyal to protest against the hoardings. Following this, the actor apologised to the public and asked his fans to not put up hoardings.

Tamil actor Vanitha Vijayakumar and her father, veteran Tamil actor Vijayakumar, have become embroiled in a feud over the family property. Vanitha has claimed that the property belongs to her mother and that she is legally entitled to stay in the house. Vanitha is the eldest daughter of Vijayakumar and late actor Manjula. Speaking to media persons in Chennai on Friday, Vanitha said, “I am staying at my mother's house. The office address of my production house is also there. No one has objected so far. We regularly give the house out for shooting. Out of nowhere, they seem to have gotten an offer from a producer to lend the house on contract. My dad asked me to vacate the house. Even after my mother passed away, I've been staying there, it's convenient for me as well. I stay with my daughter. My dad stopped the shooting and pressured me to vacate. I told him I'm willing to stop the shooting but it's not right to ask me to leave.” Vanitha filed a petition with the civil court in the city on Monday, stating that her earnings as an actor in the '90s also went into the building of the house and that she should not be dispossessed of her property. According to a report in the Times of India, Vijayakumar had lodged a complaint at the local police station in Maduravoyal as well as with the Commissioner's office on Friday. He has alleged that his daughter was refusing to vacate the house that he claims belongs to him. Vanitha, however, has alleged that the inspector at the Maduravoyal police station had beaten her and her crew members on Thursday evening and thrown them out of the house. In his complaint, Vijayakumar has reportedly stated that the property in Ashtalakshmi Nagar, Maduravoyal belongs to him. The newspaper reports that he rents out the house for shooting and that his daughter had promised to vacate within a week.

15-year-old Chennai boy dies after trying to imitate fire breathing stunt at home

An attempt to imitate professional fire breathers turned tragic when a 15-year-old boy died of burns in the Chengalpet Government hospital late on Thursday night. The incident happened when Jebin, a Class 10 student in Chennai tried to imitate the stunts performed by fire breathers. Jebin Sham, a resident of Iyancherry was alone at home at the time of his incident. His mother works as a teacher in a government school in Chengalpet while his father works in at a star hotel in Meenambakkam, Chennai. Taking a mouthful of kerosene, he spit the inflammable liquid onto a flame, so it would flare up the way he had seen performers doing so. However, some amount of kerosene fell on Jebin’s clothes and in the process he caught fire. Shocked by this, he ran out of his house crying for help. His neighbours doused the fire using water and banana leaves and called an ambulance to take him to the hospital and alerted his parents. Jebin was admitted into the Chengalpet Government Hospital late on Thursday night and treated for burns. He died a few hours later failing to respond to the treatment.   Speaking to TNM about the incident, the police officer who is investigating the case said, “This seems like a freak accident. His parents told us that he was interested in science experiments and would normally do such experiments at home. He is the only child to his parents and is a shy boy who rarely mingles with others in his school. On the day of incident, he was alone at his house since it was quarterly holidays and he was preparing for his exams. We have booked a case under section 174 of CrPC (Unnatural Death) and are looking into more angles on this.” Cautioning children and adults from trying extreme stunts at home, the police officer added, “People must know the difference between professionally trained performance and untrained trial experiments. It is important to create awareness on this, especially among school students and minors.”

Video: 3 TN men on bike ram into bus, miraculously survive

Three young men miraculously survived after they came under the wheels of a moving bus belonging to the Tamil Nadu State Transport Corporation in the outskirts of Madurai. The incident happened on September 16 afternoon at Thenur junction near Melakkal in Madurai district.   The CCTV footage shows three men on a two-wheeler turning on a curve on the road and then ramming into a TNSTC bus coming from the opposite direction. The impact of the head-on collision knocks the men off the bike. The bus stops immediately, avoiding running over the men. Bystanders are seen rushing towards the accident to help the three men. The video went viral on social media on Friday, with many suggesting that three men were under the influence of alcohol and while others commended the bus driver’s presence of mind to have stopped the vehicle immediately. Speaking to TNM about the incident, Additional Superintendent of Police Narasimha Varman said that the three youngsters were Sukumar (17), Madhusudanan (21) and Arjun (22). Madhusudanan was the one who was riding the two-wheeler at the time of accident. He also said that the bus was going to Kadupatty from Periyar bus stand, Madurai.   “The three men were drunk when they rammed into the bus and are now undergoing treatment in the Madurai Rajaji Government Hospital for their injuries. They rode the vehicle fast in the turning on the road where they should have slowed down a little. Once they are discharged, we will arrest Madhusudanan and question him. We will also frame charges against the other two who were riding pillion without helmets,” he said. The driver of the bus, Nagendran, filed a formal complaint at the Sholavandan police station and an FIR has been registered under sections of the 279 (Rash driving or riding on a public way), 337 (Causing hurt by act endangering life or personal safety of others) of the IPC. 

Salem-Chennai highway: Farmers protest soil, rock testing being carried out by govt

Farmers living along the path of the proposed Salem-Chennai expressway have raised objections to soil and rock testing work that was reportedly underway over the past week at the Jarugumalai hills in Salem district, Tamil Nadu. According to farmers in the area, the drilling work, taking place atop a remote mountain, had been ongoing for a week, but they noticed it only a few days ago. When they came to know about it and called the district administration, they allege that the district administration denied having commissioned any work. The latest protest comes even as the proposed 277.30 km-long highway to connect Chennai and Salem districts has been slammed by farmers, environmental activists and political parties for not consulting the people whose agricultural lands and livelihoods are at stake. Even as word spread about the works on Friday, nearly 100 farmers reportedly gathered at the Jarugumalai hill, demanding the work to be stopped. Speaking to TNM, Narayanan, a farmer from Kuppanur asks, “They are testing soil. We went there to protest. They pretended to stop the work last evening, but they resumed it. Government has given no explanation for this. So who is doing this work and on what basis is the work taking place?” Sivagami, a farmer from Ramalingapuram says that the police who arrived at the site on Friday sent them down the hill as soon as they began talking to the media."The matter is due in Court on Monday, why are they undertaking work now? The hill is at a height of 200 metres and the work is happening inside so we had no idea. We have stopped them from doing any further work today. None of the authorities from the Forest Department or Revenue Department have come here. They have said they will not continue the work for now,” she says. On September 14, the Tamil Nadu government had assured the Madras High Court that land acquisition proceedings for the Salem-Chennai Expressway will not be carried out until further orders. The National Highways Authority of India (NHAI) Project Director in Kancheepuram had filed an affidavit on the status of environmental impact assessment (EIA) and the feasibility studies of the project. Following the NHAI's submission, land owners had expressed fears that the government may go ahead with the land acquisition proceedings by issuing a notification under Section 3D of the National Highways Act, 1956. Section 3D of the National Highways Act, 1956 deals with declarations of acquisition made by the central government when an objection has not been raised to a project within a stipulated time period.

H Raja booked for ‘illegitimate child’ jibe against DMK MP Kanimozhi

Five months after H Raja tweeted referencing DMK’s Rajya Sabha MP Kanimozhi being the daughter of M Karunanidhi, the BJP National Secretary has been booked in Coimbatore district, Tamil Nadu on Saturday. The action has been taken on a complaint by K Velusamy, the Kaniyur Panchayat Secretary of the DMK. H Raja has been booked under Indian Penal Code Sections 500 (Punishment for defamation) and 501 (Printing or engraving matter known to be defamatory). In April this year, H Raja took a veiled shot at Rajya Sabha MP and DMK President M Karunanidhi’s daughter, Kanimozhi on Twitter. Attacking the DMK leader for lending support to a woman journalist who had condemned Tamil Nadu Governor Banwarilal Purohit’s inappropriate behaviour towards her, Raja wrote, “Would journalists question the leader who made his illegitimate child, from an illegitimate relationship, a Rajya Sabha MP, just like they questioned the Governor? Memories of Chidambaram Udayakumar, Anna Nagar Ramesh, Perambalur Sadiq Basha would haunt them.” DMK led protests across the state following the tweet. Kanimozhi, who said it was beneath her to raise to Raja's bait, also pointed out that this was the mindset prevalent against women. “Either you patronise a woman as seen in the press conference, or you try to personally attack her. Can a woman not be present in public places? This incident has shown what happens when a woman comes out in support of another,” she told TNM at the time. A day Raja's tweet, Muralidhar Rao, the National General Secretary of the BJP said, “Such remarks do not represent BJP's view neither they are in line with our party's culture.” Less than a week ago, H Raja was booked for his ‘scandalous’ comments against the Tamil Nadu police and the Madras High Court. Soon after a video of an angry Raja abusing the police and courts went viral, Raja told the press that it was not his voice in that video and that the voice had been dubbed by someone else. H Raja has also been directed to appear in Court in four week's time.

Days after controversial speech, MLA Karunas arrested by Chennai police

In a speech in Chennai, Karunas had made controversial remarks about Tamil Nadu Chief Minister Edappadi Palaniswami and Deputy Chief Minister O Panneerselvam.
The Chennai police on Sunday arrested actor Thiruvadanai MLA Karunas, from his residence in Saligramam, days after he was booked for controversial comments during a speech. According to reports, the arrest took place at around 5 am in the morning and a large number of policemen were deployed at his residence.  The actor-politician was booked by the Chennai city police on September 20 under various sections of the Indian Penal Code and the Madras City Police Act, for the speech he made in Chennai, which had gone viral on social media. The speech was delivered at Valluvar Kottam in the city. Initially, there was speculation that Karunas was on the run. Speaking to reporters in Chennai on Friday, a day after he was booked, he said, “I have not gone underground or am not hiding. I am here in Chennai. If such false reports could be circulated against a legislator, it is worrying to think of the problems faced by the common man.” Karunas had named Tamil Nadu Chief Minister Edappadi Palaniswami and Deputy Chief Minister O Panneerselvam in his speech. The actor-politician claimed that though he belonged to the 'Thevar' community, his loyalties stood with the Sasikala camp but many ‘disloyal’ members of his community had flocked to the EPS camp, referring to OPS. Stating that media outlets were owned by Iyers and Nadars, Karunas also attacked a police officer in his speech, who he claimed stopped him from standing next to the Tamil Nadu Chief Minister at an event. The comments had triggered off a massive row in the state with the Hindu Makkal Munnani filing a complaint with Chennai Commissioner of police AK Viswanathan. Speaking to Tamil news channel Puthiya Thalaimurai later, Karunas said that his intention was not to hurt any community. “I didn't speak against any community... I express my deep regret if whatever I spoke in anger over what has happened has hurt anyone. I will make sure it doesn't happen again. As far as I am concerned, I only spoke about the demands of my community. It is not my intention to demean and speak ill of others,” he said.  

'Chennai hospital protecting doctor who molested me': Woman sends legal notice

It was close to 11 pm on August 18, and 23-year-old Anitha* was lying down, barely conscious, on a bed in Vijaya Hospital. Constant bouts of fever and body pain over the last month had landed her in the High Dependancy Unit (HDU) in this Chennai hospital. The young woman, who works in New Delhi, had flown back to her hometown to address her health issues. Two doctors had already examined her, specifically her abdomen which was the main source of pain. It was initially suspected that she had contracted typhoid.  She had come into the hospital at 9 pm, and by 11 pm, she assumed the bodily checks and blood tests for the night were finally done. Family and phones were not allowed into the HDU and she was ready to get some sleep after a tiring day. But a young doctor in hospital scrubs came in to the enclosure she was in, to conduct yet another body examination. The nurse who accompanied him left them alone, and the doctor even closed the curtains, Anitha recalls."While other examinations only lasted upto three minutes, this doctor was touching and groping me for close to 15 minutes. I was so tired, I couldn't even scream," alleges Anitha. "I was in a thin hospital gown that didn't even cover my back. In the name of examining me, he touched my genitals, made me turn over and even pressed my buttocks," she adds. The continuous pressure applied to her legs and thighs was causing her skin to swell up but the doctor allegedly just used this as an excuse to touch her further."I initially gave this doctor the benefit of the doubt and thought he was doing his job," says Anitha. "But there was no reason to touch my genitals," she adds, her voice shaking."That night, I couldn't accept what happened and I just wanted to forget the ordeal," she says. "But the next day, when I woke up shivering and scared, I knew the truth. I had been molested," she adds. A case of professional abuse What Anitha alleges to have experienced is a case of professional abuse. According to activists, this is a pattern of conduct in which a person takes advantage of a victim within the context of their profession. In such scenarios the victim normally has good reason to place significant trust in the abuser. Cases of professional abuse are usually very difficult to detect and expose, especially in hospital settings. Professional organisations and licensing boards are thus expected to have strong codes of ethics that define appropriate professional behaviour and systems to investigate any allegation of violation of these ethics. But in Anitha's case, despite a complaint and legal notice, Vijaya Hospital has allegedly been protecting the accused. How the Hospital reacted On August 21, Anitha mustered the courage to give an oral complaint to the Chief Medical Officer of Vijaya Hospital. The next day, her mother gave a written complaint to the Human Resources Manager, demanding serious action be taken against the accused doctor. The family specifically pointed out that a female nurse or attendant was not present during the examination. The hospital promised to take action, but when the victim's sister expressed discomfort over their stay, authorities allegedly produced discharge papers. When the family protested, the patient was informed that she was suffering from leptospirosis the next day and advised that treatment could continue from her home."We were then told that the doctor had absconded and the hospital was unaware of his whereabouts," says Anitha. "But the next day, my father went to the hospital with our lawyer. The hospital authorities then claimed that he had informed them and gone on leave. They also said that an investigation that was conducted revealed that he was following protocol. They told my father that the doctor can talk to me and clarify the matter. But how can I sit next to my abuser and talk?" asks Anitha. When the lawyer asked for the investigation report or for details of panel members however, the hospital allegedly had nothing to offer. Anitha's lawyer then issued a legal notice to Vijaya Hospital asking for a detailed report about the action or investigation conducted against the doctor, and her father wrote to the Indian Medical Association. The legal notice stated, 'According to the medical council of India’s code of ethics, the physician shall not aid or abet torture nor shall he be a party to either infliction of mental are physical trauma are concealment of torture inflicted by some other person or agency in clear violation of human rights. Making a statement about adultery or improper conduct, the MCI says “Abuse of professional position by committing adultery or improper conduct with a patient or by maintaining an improper association with a patient will render a physician liable for disciplinary action as provided under the Indian Medical Council Act, 1956, or the concerned state medical council”.' The hospital however failed to respond to the notice in the stipulated seven days. When TNM contacted Vijaya Hospital, they confirmed that they had received both the complaint and legal notice from the victim."Our lawyer is responding to them and they will receive the information shortly," says Sebastine, head of the Human Resources team, who also happens to be the one who received Anitha's complaint. "We cannot comment further on the matter," she adds. Dr GR Ravindranath, general secretary of Doctors Association for Social Equality, points out that the absence of a nurse or attendant is against the Indian Medical Council rules."In a professional setting such as this, it is critical to take action is such cases immediately. An investigation must be held," he explains. "When a male doctor is examining a female patient there must be a female attender. The lack of a female attender by itself raises questions," he adds. For Anitha who took up a job in New Delhi just two months back, this entire ordeal has cost her both professionally and mentally. The hospitalisation and resultant legal action, has made it impossible for her return to New Delhi. She is also set to file a case against the hospital in a consumer court, which means she will have to keep coming to the city when trial begins.  *Name changed to protect identity

While condemning Karunas' comments, DMK President MK Stalin questioned why BJP National Secretary H Raja is yet to be arrested for his derogatory remarks against the Madras High Court and Tamil Nadu police.
Hours after actor-turned-politician Karunas was arrested on Sunday morning for making derogatory remarks against Tamil Nadu Chief Minister Edappadi Palaniswami and Deputy Chief Minister O Panneerselvam, the opposition has questioned the alleged hypocrisy in police action. DMK President MK Stalin, while condemning Karunas' statements, questioned why BJP National Secretary H Raja is yet to be arrested for his derogatory remarks against the Madras High Court and Tamil Nadu police. The Chennai police arrested the Thiruvadanai MLA from his residence in Saligramam at around 5 am and a posse of policemen was deployed at the venue. He had been booked by the police on September 20 under various sections of the Indian Penal Code and the Madras City Police Act, for the speech he made at Valluvar Kottam in Chennai. Karunas had claimed that though he belonged to the 'Thevar' community, his loyalties stood with the Sasikala camp but many ‘disloyal’ members of his community had flocked to the EPS camp, referring to OPS. He further criticised a police officer for allegedly not letting him stand near CM Edappadi at an event. The MLA later expressed regret over his comments and claimed that he did not mean to attack any particular community. In a statement over the arrest, MK Stalin points out that while it is unacceptable for a people's representative to speak in such a manner, Karunas' arrest shows that the same law is not applicable to everyone."By arresting MLA Karunas even after he expressed regret over his statement, they have shown that in Tamil Nadu ‘justice changes from person to person and justification changes from time to time’ (Aalukouru neethi - Velaikoru Nyayam)," reads the statement. It goes on to point out that complaints have been filed against BJP National Secretary H Raja in multiple police stations over a slew of issues - his social media post calling for the destruction of  Periyar statues in the state, for making derogatory statements against the TN police and the Madras High court and for insulting the wives of employees of the Hindu Charitable Trust employees. Stalin further points out that another prominent personality, SVe Shekhar had spoken in a derogatory manner about women journalists, his anticipatory bail petition was rejected by the Madras High Court and the Supreme Court even rejected the stay on the arrest."Despite this, it makes no sense why the AIADMK government hesitates to arrest him," says Stalin."It is highly unfair that there is a different law for Karunas, for H Raja and for SVe Shekhar. If criticising one police officer is wrong, then what about H Raja, who spoke derogatorily about the entire police force and the Madras Court? When we look at why they did not arrest Raja, it seems that Edappadi Palaniswami wants to keep the Koovathur resort mystery, which resulted in his Chief Ministerial post, a secret. He wants to control the anger and words of the people of Tamil Nadu in this aspect. It seems that is the reason that got Karunas arrested,” he adds. The DMK President alleged that the people are hanging their heads in shame over the misuse of law in the state. "So, without worrying about the background of the accused, arrests of some should be made without delay and those who should be released, should be let go immediately," he concludes. Meanwhile, the BJP, which continues to maintain that the video of H Raja abusing the Madras High Court is doctored, welcomed the arrest of Karunas.  

TN teen lynched on suspicions of theft, five men arrested

A 15-year-old boy was lynched over suspicions of theft in Karur on Sunday. Five men -- Muniappan, Muniandi, Selvakumar, Palanisamy and Manivel have been arrested by the police for attacking the boy. According to reports, 15-year-old Balasubramani lived in Allaligoundanur village in Karur district with his widowed mother who is a farm worker and his sister. He had dropped out of school after class 8 and allegedly had the habit of indulging in petty thefts after his father’s death last year. He was suspected to have stolen Rs 3,000 from Palanisamy and a mobile phone from Muniandi on Saturday. On Sunday, a few villagers informed Muniandi that they had seen the boy using the cell phone he lost. According to reports in Times of India, the five men went to his house on Sunday to question him regarding the thefts. The boy was alone in the house when the men came looking for him. The attackers were reportedly not satisfied with the boy’s answers and hence tied him up to a pole inside the house and thrashed him. When the boy’s mother and sister returned home, they found an unconscious Balasubramani. As their attempts to wake him up failed, they alerted the Velliyanai police who came to the spot. The police then found the boy dead and conducted preliminary inquiry about the incident. They then sent the body to Karur Government Hospital for autopsy. The police arrested the five men who attacked the boy and remanded them to judicial custody. According to the police, the men thought that Balasubramani was just unconscious after the attack and untied him from the pole and left him at home. He succumbed to internal injuries resulting out of the attack.

Majority of petitioners want Thoothukudi Sterlite plant closed, says NGT expert committee

The NGT appointed committee conducted inspections in and around the plant on Sunday and met the general public for their inputs on the effects of the Sterlite plant.
An expert panel with three members, led by former Chief Justice of Meghalaya High Court, Tarun Agarwal, inspected the Sterlite Copper Smelter plant in Thoothukudi on Sunday. The panel with members from the Tamil Nadu Pollution Control Board (TNPCB) and Central Pollution Control Board (CPCB) were accompanied by the district collector Sandeep Nanduri and the superintendent of police Murali Rambha on their plant visit at around 8.30 in the morning. The committee also visited a pond in T Kumaragiri to check the quality of water and A Kumarattiyapuram village which was the starting point for the anti-Sterlite protests that lasted a hundred days. After their visit, they also chaired a public consultation meeting, in which they received letters from general public about the future of the plant. Though the session was marked by minor altercations and scuffles, police intervention prevented it from becoming anything major. Most people who submitted representations to the 3-member panel do not want Sterlite plant to be reopened. Addressing the media after the public consultation, Tarun Agarwal said that a majority of the representations received by the team were in favour of the plant remaining shut. He further said that the team will study the representations and then take a call about the plant. The NGT had constituted an expert panel to study the effects of the Sterlite copper smelter plant in the region after Vedanta, the parent company of Sterlite, petitioned the NGT to consider reopening of the plant. The anti-Sterlite protests, opposing the functioning of the plant in Thoothukudi, reached a grim conclusion on May 22, after the police opened fire at the crowd killing 13 civilians. Facing severe criticism for its actions on May 22, the TN government ordered the closure of the plant and it was sealed shut on May 28 due to TNPCB violations.

Two Chennai journalists arrested for allegedly stalking, harassing woman professor

Two journalists have been arrested by the Chennai police after a woman professor accused them of harassing her. Jo Stalin, a reporter with the Vikatan group and AP Raja, a freelance reporter were taken into custody in Sunday following a complaint. The complaint was filed by a woman on Saturday, who is an English professor at a private university in Chennai. In her complaint, she said that she had known Jo Stalin from January 2017 through Facebook. After months of communicating through Facebook, both of them decided to meet at a coffee shop in Anna Nagar in May 2018. She said that since she did not like the way Stalin behaved during that brief meeting, she avoided further communication with him. The complaint also said that she became Facebook friends with Raja in April 2017 and that they were good friends. Believing that Raja was her friend, she opened up to him regarding her personal problems and he consoled her. She also said that in the second week of May 2018, Raja asked her to meet him at the Marina Beach to vent out her issues out. “That day he told me that he is in love with me, hugged and kissed me. He also thrust a ring on my finger by reciting poems and sweet words,” stated the complaint. In her complaint, she stated that in spite of her telling him that he is already married and hence a relationship is not possible, Raja refused to listen to her words and said that the marriage was arranged for property benefits and that his love was true. After she refused to listen to his persuasion, Raja visited her house in the last week of May and forced himself on her. After pleading to leave her alone, she saw a picture of Raja and Stalin together in Raja’s phone and asked him about it. After Raja told her that he and Stalin were friends for 10 years, she narrated her ordeal with Stalin to Raja. “Stalin came to know of the intimate details of the bond between me and Raja and tried to take advantage of me the same way. I told Raja to warn Stalin about his behaviour with me. I don’t know what they both spoke, but Stalin started sending me vulgar messages on WhatsApp. Stalin also threatened that he would tell this to my family and relatives and that he will insult me in my college. He also issued death threats to me,” said her complaint. She also said that these incidents caused tremendous mental agony and that she contemplated killing herself. She also said that if something were to happen to her, Raja and Stalin should be held responsible, in her complaint. The complainant spoke to TNM and said that on September 10, she called the Vikatan office to complain about Stalin. Minutes after her call, Stalin messaged her that he knew about the complaint and further threatened her. "He also called me a prostitute and repeatedly harassed me on WhatsApp. A few days later I received an email that the complaint at Vikatan has been forwarded to the higher authorities, but till date there is no action on this," she said. She also added that she tried to kill herself due to this and her brother saved her then. The Thirumangalam police booked the two men under IPC sections 354B (Assault or use of criminal force to woman with intent to disrobe), 354D (Stalking) , 506(1) (Criminal Intimidation) and section 4 of the TN Prohibition of Harassment of Woman Act of 2002 ( Penalty for harassment of woman)and arrested them on Sunday.

Rescued from TN, these bonded labourers are now living life on their own terms

A young woman stands amidst her family of seven, chirping away excitedly in Odiya as she points to a magnificent stage set up in the village of Tittlagarh in Odisha’s Balangir district. Dressed in a pink salwar, the 18-year-old is gearing up for a rare honour – she will be receiving an award from Balangir MP Kalikesh Narayan Singh Deo for being a leader her community looks up to. From her calm demeanour and ready smile, it is impossible to tell that just two years back, she was forced into a life of slavery by her own father, for an amount of Rs 16,000. Meet Pinky Kaindi, a bonder labourer-turned-businesswoman who was rescued from a brick kiln in Tamil Nadu’s Tirvallur district in 2016. Pinky along with 500 others were saved from the kiln by the district administration with the help of the International Justice Mission (IJM), which works to rescue and rehabilitate bonded labourers. They had been illegally brought from districts across Odisha after being paid advances ranging from Rs 15,000 – Rs 16,000. “I used to work for at least 15 hours a day at the kiln and even a small break meant physical and verbal abuse from the owner,” Pinky recalls. “We were beaten up a lot and I thought my life was ruined. I’ve seen the owner even misbehave with some older women,” she adds. But three months into her time at the kiln, Pinky was rescued and given a new lease of life. She was given training in tailoring at a local institute. And now the hands that shaped bricks for less than Rs 100 a week are busy stitching clothes with ease. “Just last week, I got an order for 500 uniforms,” she says proudly. “I don’t charge much because I want to first ensure that I get enough orders. But I am already earning close to Rs 4,000 a month,” she says. Pinky is just one among the five former bonded labourers who received awards for the resilience they had shown in the face of adversity. On Friday, they had all gathered in Balangir district to meet the labourers they had been rescued with, after a two-year training programme hosted by IJM to teach them fresh skills, integrate them into the system and bolster their confidence. Wearing a bright orange shirt, 27-year-old Jaya Katki stands proudly near his wife and two-year-old child. Jaya is another example of the reach of the rehabilitation programme. His son was in still in his mother’s womb when this family was rescued from the kiln in Tiruvallur district. “I thought my wife would die,” says Jaya, recalling the horror he had experienced. “She was heavily pregnant and the owner didn’t even let us go to the hospital for a check-up. He made her work over 12 hours a day even in that condition and he beat me up mercilessly if I requested him,” he adds, his voice constricting. Jaya and his wife had come to TN after taking an advance of Rs 30,000 but once at the kiln, they were paid only Rs 100 per head every week. “I couldn’t even get enough food for my wife. It felt like a nightmare we couldn’t get out of. We didn’t even have proper shelter,” he explains. But not only was Jaya rescued, he now puts a roof over several heads to earn money. “With the help of loans from government self-help groups, I started a tent business. Now we make Rs 3,000 – 4,000 a week based on the season. We have never been happier,” he says proudly. Karunas’ speech and the scramble for the Thevar vote ahead of 2019 polls

On Sunday, actor-turned-politician Karunas was arrested for a controversial speech he made in Chennai recently, instigating violence. attacking the ruling AIADMK dispensation in Tamil Nadu, a top cop in the city and the media. However, with the 2019 Lok Sabha elections less than a year away, perhaps what stood out most significantly in the speech for poll watchers is the Thiruvadanai MLA’s constant harping on Thevar caste pride. Karunas who entered politics in 2009 as founder of the Mukkulathor Pulipadai, which translates to ‘tiger army of Mukkulathors’. His is one of many such outfits that arose out of the Thevars’ need to counter the rising Dalit assertion over the past few decades in the state. Mukkulathors, meaning ‘of three clans’ comprise three sub-castes, namely the Agamudaiyars, Kallars and Maravars. They are commonly known as the Thevars and are an influential caste in central and southern Tamil Nadu, categorised as OBC or Other Backward Classes. The a large part of the traditional Thevar vote bank has, for long, been with the AIADMK for former Chief Minister Jayalalithaa’s close aide and confidant for over three decades, Sasikala Natarajan, was from the community and was able to mobilise local Thevar leaders in favour of the party. Loyalty to the Sasikala clan was also largely seen as being responsible for O Panneerselvam, a Thevar, occupying the Chief Minister’s chair thrice, twice when he stood in for Jayalalithaa. All equations were thrown to the wind, however, when Jayalalithaa died in December 2016. With a faction war breaking out on several fronts within the AIADMK, Edappadi Palaniswami, a Sasikala loyalist from the Gounder community was made Chief Minister. Panneerselvam later ‘unified’ with the AIADMK, taking on the role of Deputy Chief Minister.  This pitted two Thevar faces, O Panneerselvam and TTV Dhinakaran, who started his own party, the Amma Makkal Munetra Kazhagam, against each other. However, with the Lok Sabha elections looming closer how have loyalties shifted within the community? Speaking to TNM, Allur Sreenivasan, editor of the Trichy-based magazine ‘Avataram’ and a man who has been close to the Sasikala family for over a decade says that Karunas’ provocative speech and the aftermath will have the unintended effect of bringing together some Thevar groups ahead of the elections. Admitting that the divisions within the caste are important, he says, “The Thevar vote has always been split amongst several outfits. So they were never unified for one party during the elections. When Sasikala became General Secretary of the AIADMK (following Jayalalithaa’s death), she was mainly targeted by the Brahmins. Jayalalithaa (a Brahmim) was Accused No 1 in the Disproportionate Assets case, but Accused No 2 Sasikala and others were projected as the main culprits. This became a pattern of attack on the caste. Now, there is some unity. Even though some of Karunas’ comments are unacceptable, his speech can consolidate a few Thevar groups. After all, he is only saying all Thevars should unite.” Sreenivasan also points out that the mobilisation of youngsters in the Thevar community through viral speeches like in the case of Karunas ultimately benefits TTV Dhinakaran and Sasikala. Speaking to TNM, Professor Ramu Manivannan, head of Department of Politics and Public Administration of the University of Madras points out that no one figurehead in the party was responsible for the Thevar vote.  He says, “There could well be a split of votes between Panneerselvam and TTV Dhinakaran. If you check who has been controlling the Thevar vote bank, it is not any individual per se. It is key people inside the AIADMK, like Sasikala, Dhinakaran and few others who have been maneuvering the key constituencies by distribution of seats, of favours and party positions. They remain the key managers of this vote.” With TTV Dhinakaran pulling large crowds at his public rallies over the past year, it remains to be seen just how much damage his new party will inflict. And for both the AIADMK and TTV Dhinakaran, winning over the Thevar vote is crucial.
